Net mulls appeal to higher court

Fox News Channel may have no choice to but to shelve its legal battle against New York agent Richard Leibner, who reps CNN’s Paula Zahn.

There was never any love lost between the cable news nets, but matters got even worse when CNN offered Zahn — then a Fox newscaster — a new gig.

Fox News topper Roger Ailes responded by promptly firing Zahn. Fox then filed a lawsuit against Leibner’s agency, Bienstock Inc., alleging breach of contract.

But on April 30, a New York state appellate court affirmed a lower court ruling that there was no basis for the suit. Judges said Fox News gave up any right to match an outside offer when firing Zahn.

Fox News execs haven’t made a definitive decision about whether to appeal to ahigher court. And lawsuit or no lawsuit, Fox News continues to dominate the market, putting increasing distance between itself and CNN.
