The Federal Communications Commission said Wednesday it won’t enforce its ban on casino gambling ads in Nevada pending an appeal of a court decision that found the ad restrictions unconstitutional.

Decision should come as good news for TV and radio stations in Nevada, which have been barred from airing casino commercials.

Two Nevada stations — KVBC-TV, Las Vegas, and KRNV-TV, Reno — challenged the ad ban last year, and on April 13, a U.S. District Court in Las Vegas ruled in favor of the stations.

The court held that the FCC ad ban was overly broad, in part because the State of Nevada condones and promotes casino gambling. Though acknowledging that casino ads might be heard by viewers and listeners outside of Nevada, the court said, “(We) find it difficult to accept that commercials about legalized casino gambling located in Nevada pose any real danger to the public policies of California and Utah.”
