‘Aladdin’ cartoon injunction nixed

A New York federal judge has ruled that Walt Disney Co. has no claim to the packaging of an “Aladdin” cartoon video now in the stores and cannot prevent its distribution.

Judge Miriam Cederbaum ruled Friday that Disney could not stop the sales of the “Aladdin” vid by GoodTimes Home Video Corp on “trade dress” charges.

Disney sought an injunction against GoodTimes from using a package for the “Aladdin” vid cassette which Disney claimed had the look of their Classic Animated Features line.

The GoodTimes version of the oft-told children’s tale was released in vid stores in March, months after the Disney version opened on the big screen to raves from critics and boffo box office in October 1992. The Oscar-nominated Disney pic, which has grossed more than $ 200 mil, is set for an Oct. 1 homevid release.

GoodTimes attorney Helene Freeman said the judge clearly rejected the argument that GoodTimes had “infringed on a trade dress.””I believe it was an attempt by Disney to monopolize the market through video versions of ‘Aladdin,’ based on the premise that consumers should not have a choice,” Freeman said. Disney attorneys could not be reached for comment on the decision.
