Donald Trump Files $500 Million Lawsuit Against Univision Over Miss USA Contract

Donald Trump has filed a $500 million lawsuit against Univision Communications after the company scrapped its planned telecast of the July 12 Miss USA beauty pageant as a result of Trump’s disparaging comments about Mexican immigrants.

The Miss Universe Organization said the suit was filed Tuesday in New York State Supreme Court. The complaint also cites Univision Networks programming president Alberto Ciurana as a defendant. Univision called the lawsuit “factually false and legally ridiculous.”

In a lengthy statement about the lawsuit, Trump reinforced some of the same beliefs that led Univision to drop the telecast. NBC on Monday severed ties with Trump after more than a decade of close association with the New York real estate developer. NBC also pulled out of the planned July 12 live telecast of the pageant, to be held in Baton Rouge, La.

Trump stirred outrage at a June 16 news conference announcing himself as a candidate for the GOP presidential nomination when he described many Mexican immigrants as criminals and “rapists.” Univision and NBC have condemned Trump’s statements and cited them as the reason for yanking the pageant telecast.

“Nothing that I stated was different from what I have been saying for many years. I want strong borders, and I do not support or condone illegal immigration. There is a high level of crime occurring in this country due to unchecked illegal immigration. This is a major security issue for the United States,” Trump said. “Additionally, the terrible trade deals our government is routinely entering into with Mexico are causing great financial harm to our country. We are losing a huge number of jobs, manufacturing opportunities and money due to poorly negotiated trade deals, a fact that is indisputable. That won’t happen if I become president— this disturbing trend will end, and it will end quickly.”

Univision was just at the start of a multi-year contract for the Spanish-language rights to the Miss USA and Miss Universe pageants. NBC is in the unusual position of pulling its own property as it has been a 50-50 owner of the pageant franchise with Trump since 2002. Televisa, a part owner of Univision and Mexico’s largest broadcaster, has also scrapped plans to carry the Miss Universe pageant.

“We just reviewed Mr. Trump’s complaint for the first time, and it is both factually false and legally ridiculous,” Univision said in a statement. “We will not only vigorously defend the case, but will continue to fight against Mr. Trump’s ongoing efforts to run away from the derogatory comments he made on June 16th about Mexican immigrants. Our decision to end our business relationship with Mr. Trump was influenced solely by our responsibility to speak up for the community we serve.”

In his statement on the lawsuit, Trump claimed he got a call from an unnamed “high-ranking” Univision executive apologizing for the company’s decision. Trump has previously asserted that the Spanish-language media giant acted under pressure from the Mexican government.

“I have great respect for Mexico and love for the Mexican people and their tremendous spirit! However, their leaders and trade negotiators are far smarter than those representing the United States, and our citizens and economy are suffering greatly as a result. We have to remedy the situation and do it fast. These have long been my views and I have the courage, unlike many others, to express them,” Trump said.

The complaint asserts that Univision and NBC are attempting to suppress Trump’s First Amendment rights by putting pressure on his business ventures. The complaint cites Univision’s ties to Haim Saban, a longtime supporter of fellow 2016 presidential contender Hillary Clinton. It notes that Trump “has dramatically risen in the polls while expressing critical views of Mrs. Clinton.”

Ciurana was cited in the complaint for having posted a picture on his Instagram account that compared Trump to Dylann Roof, the man charged with the slayings of nine African-Americans in a church in South Carolina. The post was later taken down, but not before it became “the subject of hundreds, if not thousands of press articles, yet another example of Univison’s dubious efforts to create a false narrative in an attempt to upset Mr. Trump’s longstanding personal and business relationship with the Hispanic community,” according to the complaint.

The suit also maintains that Univision CEO Randy Falco and others conspired to pressure NBC to cut ties with Trump. NBC’s decision came five days after Univision publicly severed its deal with Miss USA.

According to the complaint, Univision planned to pay out in full the $13.5 million value of its five-year contract with Miss Universe Organization. The deal called for Univision to pay a license fee of $2.5 million a year for the first three years, and $3 million a year for the final two years of the contract.

The suit seeks $500 million in damages for breach of contract, defamation and intentional interference with a contractual relationship.

    Trump will prevail in his lawsuit. Simple contract law has what reasons can be used to break the contract. I’m sure there was no clause that stipulated the contract can be broken because of what Trump said. The interesting part is the damage part. Trump has enough to show he was personally affected with Facebook postings etc. He might wind up owning Univision.

    Trump is correct on all points. American citizens cannot even get jobs in their own country because our government pays employers $3,000.00 to hire hispanics and others instead. Those call centers that hire people who barely speak the language, social security information line, medicare line, all hire those who scarcely speak our language. Donald has my vote.

      1) I wasn’t aware that the Federal Government paid my local Walgreens $3000 a head to “hire hispanics.”

      2) I wasn’t aware that hispanics could NOT be American citizens.

      3) Those call centers are USUALLY staffed by Indians or Pakistanis–BOTH of which are former colonies of an English-speaking mother country.

    oh come on. We know these people aren’t criminals, except of course for coming into the country illegally{am I allowed to say that?} I am sure they aren’t bringing drugs to sell. Now just because they are desperate doesn’t mean they will do desperate things. And really any crimes committed could just as well be done by a legal American {argument made by another individual, just thought it was so wise I would repeat.} And the border being open doesn’t mean a terrorist could come in .And even if they do it’s not polite to say. No really why should they wait to come in like everyone else. Especially since the Latino community has so much power, cause that’s apparently all that matters.

      Wow, that’s nice, lets do that, maybe there will be “American” people who are willing to work in the fields for the same pay they get, yes it is a good Idea to have “Americans” to take over there jobs so that you and I pay a hamburger with the lettuce and tomato’s that can cost maybe 10 times more than it cost now because I don’t think born “American” is going to want less than the minimum hr rate in most of the cases, I think they know how hard it is to be in the sun and they will want to get pay the big bucks so that the hamburger we get in Macdonald it will no longer cost $2.99 but what about $15 dollars a hamburger? Or maybe all the jobs that the “regular American” don’t what to do like cleaning toilets or what so ever and if they do they want to get pay allot more that what they are paying now… So yea you have a very smart Idea.

    This isn’t going to go far because all entertainment contracts carry a “morality clause” that allows dismissal for anything that reflects negatively on the Network. or business enterprise.Most professional sports teams have the same clause.You disparage a race or a nationality and you’re out the door.There was nothing truthful in Trump’s statement that got him canned.The First amendment only guarantees your right to say something stupid,not stay employed after you’ve said it.

    In Trumps law suit against NBC, he seeks $500 million in damages for breach of contract, defamation and intentional interference with a contractual relationship. I’m not an attorney however, it appears that NBC has the same allegations agents Trump, for breach of contract, defamation and intentional interference with a contractual relationship with Univision! Query, in the past when employees of a network make disparaging remarked vis a vis, gender, race or other statements including remarks unbecoming and detrimental to the network! Some of those individuals have been fired:

    Broadcaster Jimmy “the Greek.”: Jimmy made a comment to the effect that “The black athlete has an advantage in the NFL, cause of the extra muscle in their legs from running away from the animals in Africa”. The next week he was gone!

    Univision host Rodner Figueroa was fired Wednesday :After comparing first lady Michelle Obama’s appearance to that of someone from the cast of the “Planet of the Apes.” “Mind you, you know that Michelle Obama looks like she’s part of the cast of ‘Planet of the Apes,’ the film,” Figueroa said was fired by the Spanish-language network for remarks he made on-air Wednesday.

    Al Campanis: “Mr. Campanis’ statements on the ABC Nightline show Monday night were so far removed from the beliefs of the Dodger organization that it was impossible for him to continue in his duties. But pressure mounted as some African-American community leaders called for Campanis to be fired. Understandably, it was widely reported as a firing.
    Since April 6, 1987, every time a Jimmy “The Greek” Snyder, Marge Schott or Reggie White made insensitive, inflammatory remarks, the Campanis “Nightline” episode was invoked. And in all those years, people who knew Campanis and many more who didn’t have been trying to reconcile his agonizingly long and lamentable comments on the program with his actions before and after.

      I’m no lawyer, but it’s just common sense that NBC would have every legal right to cut ties with a buffoon who is grossly insulting a key demographic that is important to advertisers – who after all, pay the bills. NBC shareholders would be right to be angry at any other course of action since offended viewers and advertisers tend to exert negative pressure on share value.

    Well done. What Trump stated is simply the truth. I am an immigration and 100% Latino. But I worked hard to earn my education and privilege to immigrate here. I hope Trump put the screw on NBC legally and that serves as a lesson to bullies trying to play the race card. If Trump succeeds in this lawsuit, that should establish him even further as a fighter who knows how to put the hurt in bullies and his polls should rise even further.

        Notice that Trump only mentioned drugs as a problem beginning in Mexico? In Trumpland, Americans don’t consume drugs. Mexicans just bring them here to stash them for safe keeping.

    • Trump won’t do anything more than any other president has done. Mexicans constitute a small proportion of the illegal population crossing the border now having been surpassed by Honduras, Guatemala, and San Salvador. The reason for the reduction in Mexicans immigrating to the US isn’t the stronger enforcement efforts at the border, it is because of the better employment opportunities at home – a result of the free trade deals that Trump claims he wants to reverse.

      Trump is an idiot who bloviates about his wonderful economic experience, but the man is a trainwreck that would end up doing worse damage than Obama has created. He fancies himself a new Reagan, but the Gipper was a freetrader – something Trump spent nearly an hour in New Hampshire convincing everyone that he most certainly isn’t.

    The author of this article neglects to mention that Mr. Trump was referring to illegal immigrants, not all immigrants from Mexico. Huge difference.

    • In his speech in NH he said Mexicans. He did mention illegal aliens, but he didn’t mention any other nationality except Mexicans. The video is available on youtube and is an official release from his campaign.

      He isn’t backing away from his statements about Mexicans either, so I’m not sure why you find it necessary to defend him.

        Illegals pay Social Security taxes they will never recover. Most do not get any services because they have no legitimate identification. They pay excise taxes, gas taxes, property taxes (indirectly through rent) and sales tax.

        As for the risk factor, Canada has experienced the only other ISIS attack other than the US, but everyone is freaking out about the Mexican border.

        Risk analysis seems to be your strong suit. Produce something that makes Mexico worth getting excited about (other than drugs, which is a failure of drug policy in this country).
