The 9th Circuit Court of Appeals will issue its decision on the constitutionality of Proposition 8, California’s ban on same-sex marriage, at 10 a.m. on Tuesday.
Their decision could key the case up for a showdown in the Supreme Court.
In August, 2010, U.S. District Judge Vaughn Walker overturned Proposition 8, ruling it unconstitutional. Supporters of the initiative then appealed, and have also sought to have Walker’s decision thrown out after he revealed after hearing the case that he has been in a longterm relationship with a same-sex partner.
Despite Walker’s ruling, same-sex marriages have yet to resume in California. The 9th circuit issued a stay on such nuptials until it could rule on the case.
