Kloiber holds onto soccer

Courts take matches away from ORF

With the backing of a Munich court, media mogul Herbert Kloiber has again secured top league Austrian soccer from Premiere and stopped Austrian pubcaster ORF from broadcasting the matches.

Premiere, which controls the TV rights, had sublicensed them to Kloiber’s Austrian channel ATV but withdrew them last week after ATV allegedly failed to fulfill contractual obligations. Premiere then passed the rights on to ORF, a move Kloiber quickly moved to stop by way of litigation.

The court ordered Premiere to return the broadcast of T-Mobile Bundesliga games to ATV immediately and prohibited ORF from carrying other games.

Kloiber’s Tele Munchen Group, ATV’s main shareholder, said Tuesday that it would fulfill its obligations to Premiere following the decision.

Premiere declined to comment on the ruling.
