At a hearing Monday, a federal judge scheduled the retrial of former Carolco CEO Peter Hoffman on criminal tax fraud counts for Jan. 20. U.S. District Court Judge John Davies also denied a defense motion for a judgment of acquittal.
On Oct. 7, the jury deadlocked on two counts involving $400,000 Hoffman received in 1989, while he was CEO of the now-defunct Carolco.
The government claimed the payments were income, while Hoffman maintained they were tax-free loans. A day earlier, the jury had found Hoffman not guilty on two tax fraud counts relating to his movie finance company CineVisions.
