Westinghouse’s merger with CBS remains in limbo as the federal government shutdown continues, but a majority of FCC commissioners appear set to approve the merger once the government reopens.

Sources said Nov. 15 that lingo has been added to the merger order by three commissioners – James Quello, Rachelle Chong and Andrew Barrett – making clear that Federal Communications Commission approval of the deal is not conditional on Westinghouse having agreed to beef up kids’ educational TV on CBS.

The staffs of Quello, Chong and Barrett worked together to strip the merger approval of language sought by FCC chairman Reed Hundt that could have been interpreted as a government endorsement of children’s programming quotas, sources said.
