Sats Syndex-Free

Syndicated exclusivity rules will not be applied to the distribution of signals sent to home satellite dish owners, the Federal Communciations Commission has decided. In April 1989, the FCC asked for comment on whether the syndex rules also should apply to the homedish market. In an action taken Dec. 31 but not announced until last week, the commission said it would be “infeasible” to apply the rules since “equipment to implement exclusivity protection is not currently available.”

The FCC also noted that the cost of preventing viewing by a “relatively few authorized [dish owners] for a relatively short period was significant and more than incrementally greater than the cost of syndicated exclusivity for cable.”
