Paramount Loses In Bid To Reject Ruling

Clearing the way for the third and final phase of the legal battle between Art Buchwald and Paramount Pictures over net profits for “Coming To America,” the California Court of Appeal denied a Par request to throw out a decision labeling Par’s contract with the columnist unconscionable and illegal.

The court declined to hear Par’s petition asking it to overturn L.A. Superior Court Judge Harvey Schneider’s ruling in the second phase of the trial. After establishing that the Eddie Murphy film was based on a treatment Buchwald wrote, Schneider concluded in phase two of the trial that Par’s contract with the writer was unconscionable. In its petition to the appellate court, Par argued that Schneider had overstepped his bounds, and asked the court to review the decision.
